1.1 Gegenstand dieses Software-lizenzvertrags (\u201eVertrag\u201c) ist die Einr\u00e4umung von Nutzungs- und Verwertungsrechten an der Software \u201eCASCaS, Version 1\u201c [beschrieben in Anlage 1] (\u201eSoftware\u201c bzw. \u201eLizenzgegenstand\u201c) vom Lizenzgeber an den Lizenznehmer.<\/td>\n
1.1 Licensor has agreed with Licensee to grant Licensee a license to use and exploit the software “CASCaS, version 1” set out in [Annex 1] (“Software” or “Licensed Product”) subject to the terms and conditions of this Software License Agreement (“Agreement”).<\/td>\n<\/tr>\n

2.1 Der Lizenzgeber gew\u00e4hrt dem Lizenznehmer hiermit das zeitlich und r\u00e4umlich unbeschr\u00e4nkte, einfache, nicht \u00fcbertragbare, nicht unterlizenzierbare Recht, den Lizenzgegenstand nach Ma\u00dfgabe dieses Vertrags zu nutzen, zu vervielf\u00e4ltigen, zu bearbeiten und zu dekompilieren.<\/span><\/td>\n
2.1 Licensor hereby grants to Licensee the non-exclusive, non-transferable, non-sub- licensable right to use, to copy, to revise and to decompile the Licensed Product without limitation in time, manner or place subject to the terms of this Agreement.<\/td>\n<\/tr>\n

2.3 Das Recht zur Vervielf\u00e4ltigung des Lizenzgegenstands ist beschr\u00e4nkt auf die Installation des Lizenzgegenstands auf einem im unmittelbaren Besitz des Lizenznehmers stehenden Computersystem zur Erf\u00fcllung des Nutzungszwecks und auf eine Vervielf\u00e4ltigung, die notwendig ist f\u00fcr das Laden, Anzeigen, Ablaufen, \u00dcbertragen und Speichern des Lizenzgegenstands sowie auf das Recht zur Anfertigung einer Sicherungskopie vom Lizenzgegenstand durch eine gem\u00e4\u00df \u00a7\u00a069 d Abs.\u00a02 UrhG hierzu berechtigte Person.<\/td>\n
2.3\u00a0\u00a0\u00a0 The right to copy the Licensed Product granted to Licensee herein is limited to the installation of the Licensed Product on a computer system which is in Licensee’s immediate possession and to fulfill the Purpose of Use and a copy thereof which is required for the loading, display, running, transfer or storage of the Licensed Product as well as to the right for an authorised person to make a copy for security backup purposes, as stated in sec. 69 d para. (2) UrhG (German Copyright Act).<\/td>\n<\/tr>\n

2.5 Das Recht zur Dekompilierung des Lizenzgegenstands wird nur unter der Bedingung des \u00a7\u00a069 e Abs.\u00a01 Nrn.\u00a01 bis\u00a03 UrhG und im Rahmen des \u00a7\u00a069 e Abs.\u00a02 Nrn.\u00a01 bis\u00a03 UrhG gew\u00e4hrt.<\/td>\n
2.5 The right to decompile the Licensed Product granted to Licensee herein is only granted under the terms of sec. 69 e para. (1) nos.\u00a01 to 3 UrhG and within the limits of sec.\u00a069 e para. (2) nos.\u00a01 to 3 UrhG.<\/td>\n<\/tr>\n

2.6 Weitergehende Nutzungs- und Verwertungsrechte am Lizenzgegenstand werden dem Lizenznehmer nicht einger\u00e4umt.<\/td>\n

2.7 Auf Anforderung und soweit ein berechtigtes Interesse daran besteht, wird der Lizenznehmer dem Lizenzgeber oder einem von ihm beauftragten Dritten die Pr\u00fcfung gestatten, ob sich die Nutzung des Lizenzgegenstands im Rahmen der hierin gew\u00e4hrten Rechte h\u00e4lt; der Lizenznehmer wird den Lizenzgeber bei der Durchf\u00fchrung einer solchen Pr\u00fcfung nach besten Kr\u00e4ften unterst\u00fctzen.<\/td>\n
2.7 Licensee undertakes to allow Licensor or an agent of Licensor to audit whether Licensee’s use of the Licensed Product is consistent with the rights granted to Licensee herein upon request by Licensor and provided there is a legitimate interest therein and to give full co-operation to Licensor or its agent carrying out such audit.<\/td>\n<\/tr>\n

3. \u00dcbergabe und Installation des Lizenzgegenstands<\/strong><\/td>\n

3.1\u00a0Der Lizenzgeber wird dem Lizenznehmer die zur Aus\u00fcbung der hierin gew\u00e4hrten Nutzungs- und Verwertungsrechte den Lizenzgegenstand in maschinenlesbarer Form\u00a0 per Datenfern\u00fcbertragung \u00fcberlassen. Die Parteien vereinbaren als Erf\u00fcllungsort f\u00fcr die \u00dcbergabe des Lizenzgegenstands den Sitz des Lizenzgebers. Der Lizenznehmer tr\u00e4gt s\u00e4mtliche Kosten und Risiken, die mit der \u00dcbergabe verbunden sind. Mit der \u00dcbergabe des Lizenzgegenstands geht die Transportgefahr (insbesondere die Gefahr des zuf\u00e4lligen Untergangs oder Zerst\u00f6rung) der Kopien des Lizenzgegenstands auf den Lizenznehmer \u00fcber.<\/td>\n
3.1\u00a0Licensor shall deliver the Licensed Product for the exercise of the rights to use and exploit granted to Licensee herein in machine readable form transferred by remote data transfer. The parties agree Licensor’s registered office as the place of performance for the delivery of the Licensed Product. Licensee shall bear all costs and risks related to such delivery. Upon transfer of the Licensed Product, the risk of transportation (particularly the risk of accidental loss or destruction) of the copies of the Licensed Product passes to Licensee.<\/td>\n<\/tr>\n

3.3\u00a0Der Lizenzgegenstand wird vom Lizenznehmer installiert. Der Lizenznehmer hat den Lizenzgeber auf Nachfrage schriftlich \u00fcber die jeweiligen Installationsorte der Kopien des Lizenzgegenstands zu informieren. Dies gilt ebenso f\u00fcr jegliche sp\u00e4tere \u00c4nderung der Installationsorte.<\/td>\n
3.3\u00a0The Licensed Product shall be installed by Licensee. Licensee must notify Licensor upon request in writing of the respective installation locations of the copies of the Licensed Product. This shall also apply to any later change of installation locations.<\/td>\n<\/tr>\n

3.4\u00a0Im Falle der Verletzung des Vertrags durch den Lizenznehmer hat der Lizenzgeber das Recht, auf Kosten des Lizenznehmers die L\u00f6schung s\u00e4mtlicher Kopien des Lizenzgegenstands zu verlangen, oder, soweit einschl\u00e4gig, die Abtretung solcher dem Lizenznehmer zustehenden Rechte gegen Dritte zu verlangen. Der Lizenznehmer wird dem Lizenzgeber f\u00fcr diesen Fall auf Anforderung schriftlich best\u00e4tigen, dass er keine Kopien des Lizenzgegenstands zur\u00fcckbehalten hat und dass s\u00e4mtliche Installationen des Lizenzgegenstands unwiderruflich von den Systemen des Lizenznehmers oder des Dritten gel\u00f6scht wurden. Etwaige Schadensersatz-anspr\u00fcche des Lizenzgebers werden hiervon nicht ber\u00fchrt.<\/td>\n
3.4\u00a0\u00a0\u00a0 Upon breach of contract by Licensee, the Licensor shall be entitled to require at Licensee’s expense the deletion of all copies of the Licensed Product, or if applicable, to demand the assignment of Licensee’s right of deletion against third parties. In such case upon Licensor’s request Licensee shall confirm in writing that no copies of the Licensed Product of copies thereof were retained and that all installations of the Licensed Product have been irrevocably deleted from Licensee’s or third party’s systems. Any claims of Licensor for damages shall remain unaffected.<\/td>\n<\/tr>\n

4. Lizenzgeb\u00fchren<\/strong><\/td>\n

5. Softwareaktualisierung \/ Support \/ Wartung<\/strong><\/p>\n
Der Lizenznehmer hat unter diesem Vertrag keinen Anspruch auf den Lizenzgegenstand betreffende Softwareaktualisierungen, Support oder Wartungsleistungen.<\/td>\n
5. Software Updates \/ Support \/ Maintenance<\/strong><\/p>\n
The Licensee does not have any rights to software updates, support or maintenance services concerning the Licensed Product hereunder.<\/td>\n<\/tr>\n
\n
6. Anspr\u00fcche bei Sach-\/Rechtsm\u00e4ngeln<\/strong><\/td>\n
6. Rights in Case of Defects \/ Defects in Title<\/strong><\/td>\n<\/tr>\n
\n
Eine Haftung f\u00fcr Sach- und\/oder Rechtsm\u00e4ngel ist ausgeschlossen, soweit diese M\u00e4ngel vom Lizenzgeber, seinen gesetzlichen Vertretern,\u00a0 leitenden Angestellten oder sonstigen Erf\u00fcllungsgehilfen nicht arglistig verschwiegen wurden.<\/td>\n
\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Liability in case of defects and\/or defects in title is excluded, as far as these defects are not maliciously concealed by Licensor, its legal representatives or senior executives or by other assistants in performance.<\/td>\n<\/tr>\n

7.1\u00a0Der Lizenzgeber haftet unbeschr\u00e4nkt f\u00fcr vors\u00e4tzlich oder grob fahrl\u00e4ssig durch den Lizenzgeber, seine gesetzlichen Vertreter, leitende Angestellte oder sonstige Erf\u00fcllungsgehilfen verursachte Sch\u00e4den.<\/td>\n
7.1\u00a0Licensor shall be unlimited liable for losses caused intentionally or with gross negligence by Licensor, its legal representatives or senior executives or by other assistants in performance.<\/td>\n<\/tr>\n
\n
7.2\u00a0Der Lizenzgeber haftet f\u00fcr Produkthaftungssch\u00e4den entsprechend der Regelungen im Produkthaftungs-gesetz.<\/td>\n
7.2\u00a0Licensor shall be liable in accordance with the German Product Liability Act in the event of product liability.<\/td>\n<\/tr>\n

7.3\u00a0Der Lizenzgeber haftet f\u00fcr den Verlust von Daten nur bis zu dem Betrag, der bei ordnungsgem\u00e4\u00dfer und regelm\u00e4\u00dfiger Sicherung der Daten zu deren Wiederherstellung angefallen w\u00e4re.<\/td>\n
7.3\u00a0Licensor shall be liable for loss of data only up to the amount of typical recovery costs which would have arisen had proper and regular data backup measures been taken.<\/td>\n<\/tr>\n

7.4\u00a0Eine weitere Haftung des Lizenzgebers, insbesondere eine Haftung f\u00fcr leicht fahrl\u00e4ssig durch den Lizenzgeber, seine gesetzlichen Vertreter, leitende Angestellte oder sonstige Erf\u00fcllungs-gehilfen verursachte Sch\u00e4den, ist dem Grunde nach ausgeschlossen.<\/td>\n
7.4\u00a0Any more extensive liability of Licensor, in particular liability for damages caused with slight negligence by Licensor, its legal representatives or senior executives or by other assistants in performance, is excluded on the merits.<\/td>\n<\/tr>\n

8.1\u00a0\u00c4nderungen dieses Vertrags bed\u00fcrfen zu ihrer Wirksamkeit der Schriftform. Dies gilt ebenso f\u00fcr die \u00c4nderung dieses Schriftformerfordernisses.<\/td>\n
8.1\u00a0Amendments or additions to this Agreement must be made in writing to be effective. This shall also apply to amendments of this written form requirement.<\/td>\n<\/tr>\n

8.2\u00a0Auf diesen Vertrag findet das Recht der Bundesrepublik Deutschland mit Ausnahme des UN-Kaufrechts (United Nations Convention on Contracts for the International Sale of Goods vom 11.\u00a04. 1980) Anwendung.<\/td>\n
8.2\u00a0This Agreement shall be governed by the laws of the Federal Republic of Germany except for the UN Sales Convention (United Nations Convention on Contracts for the International Sale of Goods dated 11.\u00a04. 1980).<\/td>\n<\/tr>\n

8.3\u00a0Die Parteien vereinbaren den Sitz des Lizenzgebers als ausschlie\u00dflichen Gerichtsstand f\u00fcr s\u00e4mtliche Streitigkeiten aus und im Zusammenhang mit diesem Vertrag, vorausgesetzt dass der Lizenznehmer ein Kaufmann im Sinne des deutschen Handelsgesetzbuchs ist oder der Lizenznehmer bei Klageerhebung keinen Sitz in der Bundesrepublik Deutschland hat.<\/td>\n
8.3\u00a0The courts for Licensor’s registered office shall have exclusive jurisdiction over all disputes under and in connection with this Agreement, provided that Licensee is a merchant within the meaning of the German Commercial Code or if upon the commencement of legal proceedings, Licensee has no place of business or ordinary residence in the Federal Republic of Germany.<\/td>\n<\/tr>\n

Die Software “CASCaS” ist eine kognitive Architektur mit Hilfe derer Verhalten von Operatoren einer Maschine (z.B. Autofahrer, Flugzeugpiloten oder Seefahrer) auf Basis psychologisch und physiologisch plausibler Modelle beschrieben werden kann.<\/p>\n
Zur Funktionsweise der Software “CASCaS”:<\/p>\n
Die Architektur ist ausf\u00fchrbar und kann ein in der CASCaS-Notation verfasstes Aufgaben-modell und eine Topologie laden. Letztere beschreibt die physischen Eigenschaften einer Bedienungsschnittstelle und ihrer physischen Umgebung zu dem Zweck, CASCaS an die Simulationsumgebung anzuschlie\u00dfen. Das Aufgabenmodell beschreibt die Aufgaben des Operators zur Bedienung der Maschine. Nach Ausf\u00fchrung der Software CASCaS erh\u00e4lt der Nutzer ein Simulationsprotokoll als Ergebnis. Dieses beschreibt in einem hohen Detailierungsgrad die simulierte Nutzung der Maschine durch den Operator.<\/p>\n

Die Software CASCaS wird ohne ein Handbuch oder anderweitige Dokumentation geliefert.<\/p>\n

Ausschlie\u00dflicher Nutzungszweck ist der Einsatz zum Gewinn wissenschaftlicher Ergebnisse und Erkenntnisse, d.h. zur Erstellung kognitiver Modelle oder Aufgabenmodelle (z.B. Autofahren oder Fliegen) oder zur Modellvalidierung der genannten erstellten Modelle sowie zur \u00dcberpr\u00fcfung der bereits publizierten Ergebnisse.<\/p>\n
<\/p>\n
Mit CASCaS k\u00f6nnen z.B. einer Publikation beiliegende Modelle (d.h. die Topologie, sowie das Aufgabenmodell eines Operators) geladen und anschlie\u00dfend simuliert werden. CASCaS simuliert anhand psychologischer und physiologischer Modelle menschliches Verhalten (wie z.B. Blick\u00e4nderungen, Interaktionen mit dem System, z.B. durch H\u00e4nde u. F\u00fc\u00dfe, auditive Kommunikation durch Sprache oder akustische Signale, aktive Ziele und gefeuerte Regeln). Wie jede kognitive Architektur werden daf\u00fcr abstrakte Modelle der Realit\u00e4t verwendet. Die Software CASCaS wird in der Bin\u00e4rversion (Objektcode) ausgeliefert, welcher einen Start von CASCaS auf einem PC mit mind. 2 GB Ram und dem Betriebssystem Windows 7 erm\u00f6glicht. Eine Ausf\u00fchrung auf einem anderen Betriebssystem oder einer anderen Betriebssystemversion wurde nicht getestet und kann daher zu einem Absturz der Software f\u00fchren. CASCaS verwendet die folgende Fremdsoftware (Bibliotheken), deren Verwendung jeweils den beigef\u00fcgten Lizenzbedingungen (siehe \u201e3rd-party-licences\u201c Ordner) gestattet ist: Glib, GTK, Libxml, Pango, DevIL, GraphVIZ.<\/p>\n
Das Laden anderer als der von OFFIS im Rahmen von a) Publikationen zur Verf\u00fcgung gestellten Modelle oder b) mittels von OFFIS zur Verf\u00fcgung gestellter Software wurde nicht getestet und kann daher zu einem Absturz der Software f\u00fchren.<\/p>\n

The software \u201cCASCaS\u201d is a cognitive architecture, based on psychological and physiologically sound models, which allows to describe behavior of machine operators (e.g. car drivers, aircraft pilots or seafarers).<\/p>\n
Operation of the software \u201cCASCaS\u201d:<\/p>\n
CASCaS is executable and can read a topology and a task model in CASCaS notation. The topology describes the physical properties of a user interface and its physical environment for the purpose of connecting CASCaS to the simulation environment. The task model describes the tasks an operator has to perform to use the machine. After execution of CASCaS, the user gets a simulation protocol as a result. This protocol describes the simulated use of the machine by the user on a very detailed level.<\/p>\n

The software CASCaS is delivered without handbook or any other documentation.<\/p>\n
<\/p>\n
The only purpose for using CASCaS is the gain of scientific results and findings, i.e. for specification of cognitive models or task models (like driving or flying), or for validation of the mentioned models, as well as to proof that published results produced by CASCaS are scientifically plausible.<\/p>\n

<\/p>\n
With CASCaS, models (i.e. the topology and the task model of an operator), e.g. which accompany a publication, can be loaded and afterwards simulated. CASCaS simulates human behavior based on psychological and physiological models (e.g. gaze changes, interactions with the system via hand\/foot, auditive communication like voice or acoustical signals, active goals and fired rules). Like every cognitive architecture, CASCaS uses abstract models of the reality for the simulation, thus the predictions are only approaches to reality of human behavior. Predictions of CASCaS can be used for comparison of different systems (i.e. different versions of an assistant system), only without taking absolute values into account. As this, CASCaS is only valid in simulation environments, and cannot be used in real vehicles for prediction of real operator behavior.<\/p>\n

CASCaS is delivered in binary version (object code), which allows to start CASCaS on a PC with a minimum of 2 GB RAM and an operating system Windows 7. Execution on any other operating system or version of operating system has not been tested and can result in a failure (crash). CASCaS uses the following 3rd-party libraries, whose use is granted with their own attached licenses (see folder \u201c3rd-party-licenses\u201d): Glib, GTK, Libxml, Pango, DevIL, GraphVIZ.<\/p>\n
